Casos en los que tenemos derecho a sustituciones inmediatas (nueva regulación)
En la Ley 48/2015, de 29 de octubre, de Presupuestos Generales del Estado para el año 2016, en su disposición final décima quinta se establece la modificación del artículo 4 del Real Decreto-ley 14/2012, de 20 de abril, de MEDIDAS URGENTES DE RACIONALIZACIÓN DEL GASTO PÚBLICO en el ámbito educativo
A PARTIR DEL 1 DE ENERO DE 2016 podrá procederse a la inmediata sustitución de docentes en los siguientes casos:
<ul><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Profesorado que preste atención a alumnado con necesidades específicas de apoyo educativo.</span></p> </li><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Centros docentes que tengan implantadas menos de dos líneas educativas.</span></p> </li><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Profesorado de segundo curso de Bachillerato.</span></p> </li><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Sustitución por maternidad, paternidad, adopción o acogimiento, tanto preadoptivo como permanente o simple.</span></p> </li></ul> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"><br /></p> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;"><u><b>DE MOMENTO en Castilla y León sigue vigente la instrucción 26 de junio de 2012</b></u></span><span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;"> por la que </span><span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;"><b>podrán autorizarse con carácter prioritario</b></span><span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;"> (sin esperar al transcurso de los 10 días hábiles)</span><span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;"><b> las siguientes sustituciones</b></span><span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;" />: <!--more--> </span><p><br /></p> <ul><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Centros de especial dificultad, escuela unitaria, Colegio Rural Agrupado, centro incompleto o centro compuesto de dos o más edificios en distintos recintos.</span></p> </li><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Tutor/a de los niveles de Educación Infantil o primer ciclo de Educación Primaria, o bien a un maestro/a de Educación Especial o Compensatoria.</span></p> </li><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Cuando no exista profesorado con disponibilidad horaria para desempeñar funciones de apoyo.</span></p> </li><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Cuando se produzcan dos o más ausencias simultáneamente en el mismo centro.</span></p> </li><li> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="justify"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;">Sustituciones por permisos no retribuidos.</span></p> </li></ul> <p class="western" style="margin-bottom: 0cm; line-height: 150%" mce_style="margin-bottom: 0cm; line-height: 150%" align="center"> <span style="font-family: Times New Roman,serif;" mce_style="font-family: Times New Roman,serif;"><b>En tales casos es importante que los centros exijan tales sustituciones inmediatas a la Sección de Gestión de Personal de la Dirección Provincial cuando se comuniquen las ausencias.</b></span></p> </div>
